Civic Mart OLCC Board Hearing: SUCCESS

Short version- The OLCC Board of Commissioners voted 4-0 to grant the Civic Food Mart a liquor license WITH the 4 current restrictions:


1) No sale of malt beverages larger than 24 ounces
2) No fortified wines/malt beverages more than 6% alcohol
3) No glass containers
4) No liquor sales after 9:30pm

Long version- Prior to the neighbors and officials comment period, the OLCC staff presented their report to the Board with the recommendation that the license be granted with NO restrictions. The Board openly debated whether the neighborhood has improved because of the restrictions. The OLCC staff's response was that when there is a change of ownership, the OLCC is has the burden to prove that there is a legal basis for applying restrictions. The board chair commented that he believed that the board had a right to not base their decisions solely on the legal findings of the OLCC staff's report.

Then something interesting happened

The Board invited Mr. Baek (new owner of the Civic Food Mart) and his daughter to comment. His daughter speaking for her father commented to the Board that they were fine with the restrictions on their license. Concerned that there was a possible miscommunication, the board rephrased the question 3 times in an effort to ensure that we all heard them correctly. After Mr. Baek's comments, the Board opened the floor to the public for 2 minute comment periods.

In addition to the above speakers, letters from Commissioner Jeff Cogen and
PNA Chair Linda Aruda were entered into the record. In the interest of time, 4
residents that had shown up to speak, withdrew their request to speak to the Board.

The Board then proceeded to vote on granting the license WITH the 4 restrictions. Commissioner Robert Rice paused the voting and asked that the record reflect that Mr. Baek had voluntarily agreed to have the restrictions kept in place. Once confirmed, Commissioner Rice also cast his "aye" vote making it 4-0.

If folks would please comment on this post and leave observations on what they feel worked...and what didn't work. We as a neighborhood, and a neighborhood association need to build a 'knowledge base' that can be passed forward so that next time something like this comes up we don't have to reinvent the wheel.

I would like to thank Mr. Baek. I will personally invite him and his family to future PNA general meetings and make every effort to ensure knows that his business is in a community that appreciates and supports those that help us build a better neighborhood.

OLCC & Piedmont Meeting: Recap

Today in the Fireside Room of the Peninsula Park Community Center 5 PNA board members, 10 residents, PPB Officer Lisa Clayton met with OLCC Executive Directory Stephen Pharo and 3 OLCC folks. Previous to the larger meeting the OLCC group met w/ Amie Massier (Peninsula Park Community Center Director). The OLCC's Stephen Pharo's visit was to survey the park, the community center, and to listen to resident's concerns first hand. This was in addition to the overwhelming number of letters to the OLCC opposing the removal of the Civic Food Mart's liquor license restrictions.

Stephen Pharo opened by asking residents to describe what the neighborhood "was" vs what it is now. PNA Parks Co-Chair Allan Folz was first up commenting that we don't have to look at the neighborhood's distant past to point out problems, but rather just look to recent events (e.g., shootings, hit and run) to see that the neighborhood is not the calm oasis they claim (paraphrased heavily). Resident after resident spoke up with their observation that the lifting of the restrictions (for more info on the restrictions, see HERE) would be the magnet that would draw crime and irresponsible behavior to the park and community where we live and breath every day.

The OLCC team left the concluded the meeting by restating that the hearing this Friday will still occur and that residents and concerned citizens should come and address the OLCC Board of Commissioners. The board will vote on the restrictions immediately following the comment period.

The OLCC hearing is scheduled for Friday, April 18th at 9am. The hearing will be located at 9079 SE McLoughlin Blvd., Room 103A, Portland, Oregon, 97222. You must show up at 9am and sign in with OLCC employee Carrie Korbe (she will be in the front lobby) if you wish to speak to the OLCC Board. For those that will be speaking, the time allowed for this issue is during the "License Matters" portion of the agenda (not the "Public Forum").

OLCC...WHAT THE HELL ARE YOU DOING?!?!

The PNA has received the following from the OLCC...

Just an FYI: this months Commission meeting is scheduled for Friday, April 18th at 9am. The only licensing matter for the Portland area is Civic Food Mart. The recommendation going to the Commissioners is to grant the license without the restrictions.

If you or any of the neighbors would like to speak to the Commissioners about this
license matter, please be sure to sign in with me the morning of the meeting. I will be right up front when you come in with a sign in sheet.

THEIR RECOMMENDATION IS TO GRANT THE LICENSE WITHOUT RESTRICTIONS?!?! ARE YOU KIDDING ME? WHAT ARE YOU THINKING?!

-53 letters from the community in opposition to the lifting of restrictions.
-Letter from the Chief of Police with a "recommendation of no endorsement"
-Public Safety Manager for Portland Public Parks opposes the lifting of restrictions
-Peninsula Park Community Center opposes the lifting of restrictions
-Piedmont Neighborhood Association STRONGLY opposes the lifting of restrictions
-300 feet of a children's playground
-the store is in a designated "Alcohol Impact Zone"

The OLCC's recommendation is detrimental to our community. Take action and show up to the hearing. Let the OLCC know that this is our neighborhood...our community...our lives. The OLCC's behavior is unacceptable.

I have sent an email to the OLCC's Carrie Korbe requesting the location of the hearing (note that bit of info was conviently left out of their letter to us). I will post on this blog as soon as hear from them.

Civic Food Mart Liquor License - Update

Well it looks like Chief Sizer is now on my christmas list!

The PNA was given a copy of THIS letter from the City of Portland Bureau of Police to the Oregon Liquor Control Commission. Essentially the Chief of Police has forwarded a "no endorsement recommendation" to the OLCC.

Other bits from the letter...

Between 2007-01-01 and 2008-01-01 there were 37 calls for police service within 500 feet of the Civic Food Mart. Of those 37, 22 were within 100 feet.

and...

While these restrictions have remained in place Peninsula Park has become a mecca for the Piedmont Neighborhood Community and surrounding communities to visit. Peninsula Park is viewed as a safe, family-friendly place to gather. Lifting the restrictions in all likelihood would return the area to the state it was in during the 1980's and 1990's...

Civic Food Mart Liquor License - TIME FOR ACTION

Recap: The Civic Food Mart (located HERE) has changed ownership and the new owners have want the OLCC to remove the 4 restrictions from their liquor license.
1) No sale of malt beverages larger than 24 ounces
2) No fortfied wines/malt beverages more than 6% alcohol
3) No glass containers
4) 9:30pm closing time

The OLCC has cited the reduction in crime and alcohol-related mischief since the restrictions were enforced as cause REMOVE the restrictions! The Piedmont Neighborhood Association (PNA) contends that the reason there is reduced crime and alcohol-related problems is directly related to the restrictions!!! Additionally, we're talking about an establishment 200 feet from a kid's playground that wants to sell high alcohol beverages in glass containers!

The OLCC will remove the restrictions unless the neighborhood responds by March 1st, 2008

The PNA has officially voiced our opposition to the OLCC removing the restrictions. However, we need you to write a letter, call, or email the OLCC and voice your opinion!

Here what the Civic Food Mart has applied for to the OLCC...

The applicant has applied for a Wholesale Malt Beverage and Wine license which allows the importation, storage, transportation, wholesale sale and distribution to licensees of the Commission, and the export of wine containing not in excess of 21% alcohol by volume and malt beverages. The license also allows the sale of malt beverages containing not more than 8% alcohol by volume in quantities not less than 5 gallons to any unlicensed organization. The licensee can not sell alcoholic beverages for consumption on the licensed premises.

The applicant has also applied for an Off-Premises Sales license, which allows the licensee to sell factory-sealed containers of malt beverages containing not more than 14% alcohol by volume, wine containing not more than 21% alcohol by volume or cider containing not more than 10% alcohol by volume for consumption off the licensed premises. Legal hours of sale are 7:00 a.m. to 2:30 a.m.

The applicant has applied for a Full On-Premises Sales license, which allows the license to sell wine containing not more than 21% alcohol by volume, malt beverages containing not more than 14% alcohol by volume, cider containing not more than 10% alcohol by volume, and distilled liquor by the drink to patrons on the premises. Legal hours of sale are 7 a.m. to 2:30 a.m. The applicant’s proposed hours of operation are 6 a.m. to 12 a.m., seven days per week.

The applicant has applied for a Limited On-Premises Sales license, which allows the licensee to sell wine containing not more than 21% alcohol by volume, malt beverages containing not more than 14% alcohol by volume, and cider containing not more than 10% alcohol by volume by the drink to patrons on the premises. It allows the sale of malt beverages in kegs holding not less than seven gallons for off-premises consumption. Legal hours of sale are 7 a.m. to 2:30 a.m.

Office of Neighborhood Involvement (ONI) responded to Brian Borrello's previous email with the following...

I have been speaking with the OLCC about this location. They request that you send a letter of opposition directly to them. In order to get it on the agenda for the Commission Hearing in April (March is a phone meeting and therefore unavailable for our purposes), we must show significant public opposition in the absence of other statistical evidence that the restrictions need to stay in place.

Could you provide us with the restrictions for Civic Mart currently in place and
those they wish rescinded.The proximity to Peninsula Park, Community Ctr,
and playground warrant our close attention here.

There are currently 4 restrictions on this location.
1) 9:30 closing time

The owner is willing to abide by the restrictions on his hours of operation as he intends to close at 9pm, anyway. According to the OLCC investigator, he will not commit to voluntarily continuing the other three restrictions.

Mark Warrington from Portland Parks and Recreation has expressed his opposition. The Crime Prevention Coordinator, Mary Tompkins, has committed to writing a letter of opposition stating the positive impacts of the current restrictions. I will be contacting Amy Masier at the Community Center for her thoughts on the matter, as well.

Civic Food Mart Liquor License - Update

Piedmont Neighborhood Association Land Use Co-Chair Brian Borrello has responded to Thresea Marchetti of the Office of Neighborhood Involvement (ONI)...

You state: "I have received a liquor license application for a change in ownership at an existing Market in the Piedmont neighborhood area. Civic Food Mart located at729 N Rosa Parks Way has applied to maintain the Off Premises sales license which allows the sale of beer/wine/cider to go in sealed containers."

There seems to be a difference between "maintaining" existing restrictions and "lifting" them as recommended by the OLCC state employee.

Could you please clarify this distinction?

What are the limitations currently in place, and what are being proposed?

The owners of this establishment have tried every few years to have the restrictions lifted, and we have consistently had numerous people testify against, and the restrictions subsequently have been ruled to remain in place. These restrictions are not onerous- the limitation of fortified wines and liquors' sales/ no extended hours of operation/etc were advocated for, and we even made concessions so as not to adversely affect their business. The impact of alcohol related disturbances and crime in proximity (within 150ft) to a children's playground, community center, swimming pool, and public parkshould not be overlooked so a business owner can maximize his profits. I think the message is and has been clear to OLCC, and to the owners, of the citizenry's position,so why is this even being considered yet again by this state regulatory agency?

Piedmont NA will offer fierce opposition to lifting these restrictions.

Please advise as to when the OLCC hearing will be held, so we can notify all concerned community members and prepare testimony.

Civic Food Mart Liquor License

The PNA received the following from The Office Of Neighborhood Involvement.

I have received a liquor license application for a change in ownership at an existing Market in the Piedmont neighborhood area. Civic Food Mart located at729 N Rosa Parks Way has applied to maintain the Off Premises sales license which allows the sale of beer/wine/cider to go in sealed containers.

The listed hours of operation are: Sunday thru Saturday 7am to 9pm. The application contact is: Seoung Hoon Baek

If you are aware of any existing problems or concerns at this location, please let me know by 2-23-08. Changes in ownership are typically routine paperwork; however, if there is a good neighbor agreement in place or identified problems at the location it can provide an opportunity for problem solving. If you have concerns regarding this license, please list the concerns in writing and remember they must be related to crime, alcohol, alcohol related behavior or drugs. Traffic, Parking and Trash are not considered during the licensing process at OLCC.

We would like to see all current restrictions remain in effect with the new owners.Piedmont NA strongly advocated for existing restrictions to remain in place at the OLCCappeals hearing 2 years ago. We even negotiated some concessions with that ownerthat might have been onerous to his sales. The close proximity of liquor sales to a children's playground and community center,as well as past alcohol-related crime and disturbances in the area were, and should be currently noted.

While it is the Board's prerogative and responsibility to establish the official position of the association, each member has an individual right to participate in the process and to make their voice heard to regulators.
